Agency Health Labs Pty Ltd (ABN 84 686 846 604) (Agency Health, we, us or our) is committed to protecting the privacy and confidentiality of your personal information.

We provide preventative health services through our online platform (Platform). Users of our services (Users) can engage with our Australian medical staff and access pathology tests to help identify and manage health risks before disease onset.

This is a consent form for the handling of your personal information, including your health information.

Our Privacy Policy explains the meaning of 'personal information', how we collect, use, disclose and store your personal information, and how you can access and correct your personal information or make a complaint.

We will handle your personal information in accordance with applicable privacy and health records laws, including the Privacy Act 1988 (Cth) and its 'Australian Privacy Principles', and the following state and territory legislation:

  • the Health Records Act 2001 (Vic) and its 'Health Privacy Principles' in Victoria;
  • the Health Records and Information Privacy Act 2002 (NSW) and its 'Health Privacy Principles' in New South Wales; and
  • the Health Records (Privacy and Access) Act 1997 (ACT) and its 'Privacy Principles' in the Australian Capital Territory.

What personal information do we collect from you?

We may collect the following personal information from Users:

  • your name, address, date of birth, email and contact details;
  • your Medicare number, and other relevant government identifiers;
  • your health and medical history, medications, lifestyle history, family history and genetic information and ethnic background;
  • your health goals; and
  • your payment and billing details.

We collect personal information from persons other than Users, such as service providers, contractors and third parties we engage with, to enable us to work, transact or engage with them. This will include contact details and other relevant personal information of such individuals which they provide or which we request and collect from them.

Purposes of collection, use and disclosure of your personal information

If you are a User, we collect, use and disclose your personal information for purposes including:

  • to provide our services to you and communicate with you in relation to those services;
  • to allow you to access and engage with the Platform;
  • to help us manage our accounts and administrative services, related to the services being provided to you;
  • to obtain, analyse and discuss test results from pathology laboratories; or
  • to request your participation in a quality improvement activity, clinical trial or research.

If you are a person other than a User, such as a service provider, contractor or other third party we engage with, we will collect, use and disclose your personal information to the extent necessary for our functions or activities, and to work, transact or engage with you.

We will generally only disclose your personal information to other persons for the main purposes for which you have provided it to us, which if you are a User will usually be for the purposes of you receiving services from us.

In particular, if you are a User, we may disclose your personal information to:

  • pathology laboratories and other health service providers that are part of your treating team; or
  • Medicare,

where this is necessary for your ongoing care and support. Please tell us if you do not wish for your personal information to be disclosed to a particular health professional or organisation.

If you are a person other than a User, such as service providers, contractors and third parties we engage with, we may disclose your personal information to manage our relationship with you.

We may use your personal information (such as your name and contact details) to send you marketing communications about our products and services, including by SMS, email, or other electronic means. We will only do so as permitted by applicable law, including the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth). You may opt out of receiving marketing communications at any time by using the unsubscribe function we provide with such communications or by contacting us using our contact details as set out in our Privacy Policy.

We use Meta Pixel and Meta Conversions Application Programming Interface (API) to measure the effectiveness of our advertising on Meta platforms (Facebook and Instagram). Use of Meta Pixel helps us understand how visitors interact with our website. When you visit our website, including when you sign-up to the Platform, checkout or make a purchase with us, data about this activity and your browsing behaviour may be collected and disclosed to Meta Platforms Inc. based in the United States. Your health information will not be disclosed to Meta Platforms Inc.

We use Sentry (Functional Software, Inc., based in the United States) to identify and monitor for any errors, bugs, and other performance issues that are occurring in the Platform, to help us resolve these types of issues. Information we send to Sentry may include IP addresses and user identifiable data to the extent this is needed to search for and diagnose issues encountered by users.

We take reasonable steps to ensure your personal information is handled by Meta Platforms Inc. and Sentry in accordance with the APPs.

We will otherwise only disclose your personal information to other persons for other purposes for which you have provided consent, or whether this is otherwise authorised or required under law.

By agreeing to this consent form below and submitting it to us or otherwise providing your agreement to this consent form to us in writing (including electronically), you acknowledge and agree that:

  • You have read and understood our Privacy Policy.
  • You agree to the collection, use, disclosure and other handling of your personal information in accordance with this consent form and our Privacy Policy.
  • Without your consent, we may not be able to provide you with some or all of our services or engage with you.
